Tiến Sĩ Vai trò của các cơ quan thanh tra nhà nước trong kiểm soát việc thực hiện quyền hành pháp ở Việt Nam

1. Vai trò của các cơ quan thanh tra nhà nước trong kiểm soát việc thực hiện quyền hành pháp là những tác động, ảnh hưởng và đóng góp của các cơ quan thanh tra nhà nước bao gồm Thanh tra Chính phủ, Thanh tra tỉnh, Thanh tra huyện, Thanh tra bộ, Thanh tra sở trong việc xem xét, đánh giá và xử lý theo thẩm quyền đối với việc tổ chức thực hiện chính sách, pháp luật, nhiệm vụ của các cơ quan hành chính nhà nước, người có thẩm quyền trong cơ quan hành chính nhà nước thông qua việc thực hiện chức năng thanh tra, giải quyết khiếu nại, tố cáo và phòng, chống tham nhũng.

2. Quá trình thực hiện vai trò của các cơ quan thanh tra cũng bộc lộ một số hạn chế, bất cập: (1) Trong hoạt động thanh tra có lúc, có nơi chưa kịp thời, nhiều vụ việc vi phạm pháp luật chậm bị phát hiện và xử lý gây thiệt hại lớn cho nhà nước, ảnh hưởng đến quyền và lợi ích hợp pháp của công dân, cơ quan, tổ chức; hoạt động thanh tra còn tập trung nhiều vào thanh tra các doanh nghiệp, chương trình, dự án; chưa chú trọng đúng mức tới hoạt động thanh tra trách nhiệm của các chủ thể quản lý nhà nước; (2) Hoạt động tham mưu giải quyết khiếu nại, tố cáo còn tồn đọng; tỷ lệ khiếu nại đúng của công dân lớn nhưng xử lý trách nhiệm của cán bộ, công chức còn hạn chế; (3) Hiệu quả hoạt động phòng, chống tham nhũng của các cơ quan thanh tra nhà nước chưa cao.

3. Từ những đánh giá thực trạng việc thực hiện vai trò và quan điểm phát huy vai trò của các cơ quan thanh tra trong kiểm soát việc thực hiện quyền hành pháp, Luận án đã đưa ra một số giải pháp phát huy vai trò của các cơ quan thanh tra trong kiểm soát việc thực hiện quyền hành pháp như sau: (1) Tăng cường tính hệ thống của các cơ quan thanh tra nhà nước. (2) Tiếp tục hoàn thiện chức năng, nhiệm vụ, quyền hạn của các cơ quan thanh tra. (3) Đổi mới phương thức hoạt động của các cơ quan thanh tra nhà nước. (4) Tăng cường sự phối hợp trong hoạt động của các cơ quan thanh tra nhà nước với các cơ quan có chức năng kiểm soát việc thực hiện quyền hành pháp khác .và tiếp tục hoàn thiện cơ sở pháp lý phục vụ nâng cao hiệu quả hoạt động công tác thanh tra, giải quyết khiếu nại, tố cáo và phòng, chống tham nhũng của các cơ quan thanh tra nhà nước.

SUMMARY OF THE MAJOR CONCLUTIONS

1. The role of the state inspection bodies in controlling of the exercise of executive power is the impact, influence and contribution of the state inspection bodies including Government Inspector, provincial Inspector, district Inspector, ministerial Inspector, department Inspector in the review, evaluation and process, according to the competence, the implementation of policies, laws and duties of the state administrative bodies, the competent persons in state administrative through the implementation of inspection functions, settle complaints and denunciations and prevention of corruption.

2. The process of performing the role of inspection agencies also expressed some limitations and shortcomings: (1) During inspection activities, there are many law violation cases slow detected and handled, causing great damage to the state, affecting the rights and legitimate interests of citizens, agencies and organizations; inspection activities are focused on inspections of businesses, programs and projects; not paid proper attention to the inspection activities of the entity responsible for managing the state; (2) Advising activities to settle complaints and denunciations is backlog; percentages of citizens’ right complaints are high but the responsibility of officials and employees is limited; (3) The effect of prevention and anti-corruption of the state inspection bodies is not high.

3. From the assessments on the implementation of the role and on the perspective to promote the role of the inspection bodies in the exercise of executive control power, the thesis has launched a number of measures to promote the role of the inspection bodies in the exercise of executive control power as follows: (1) Strengthening the system of state inspection bodies. (2) Continue to improve the functions, duties and powers of the inspection agencies. (3) Innovating the mode of operation of the state inspection bodies. (4) Strengthen the coordination of the activities of the state inspection bodies with the other authority which controls the exercise of executive power . and continue to improve the legal basis for raising the efficiency of inspection activities, settle complaints and denunciations and prevention of corruption of the state inspection bodies.
