TÓM TẮT NHỮNG KẾT LUẬN MỚI CỦA LUẬN ÁN

1. Thực hiện pháp luật về quyền kinh tế, xã hội và văn hóa đối với người dân tộc thiểu số là tổng thể các hoạt động có mục đích, có chủ định của các cơ quan nhà nước, các tổ chức xã hội và các cá nhân người dân tộc thiểu số nhằm đưa các quy phạm pháp luật về quyền kinh tế, xã hội và văn hóa đi vào cuộc sống của người dân nơi đây.

2. Yêu cầu của thực hiện pháp luật về quyền kinh tế, xã hội và văn hóa đối với người dân tộc thiểu số phải bảo đảm đúng đối tượng thụ hưởng quyền, cũng như phải đảm bảo sự công khai, minh bạch, bình đẳng và phải tương thích với các tiêu chuẩn quốc tế và đề cao các quyền con người được ghi nhận trong Hiến pháp 2013.

3. Thực hiện pháp luật về quyền kinh tế, xã hội và văn hoá đối với người dân tộc thiểu số là phương tiện hữu hiệu giúp người dân tộc thiểu số phát triển các năng lực làm chủ, tích cực tham gia vào công việc quản lý nhà nước và xã hội; là một phương thức bảo đảm an toàn xã hội, an ninh biên giới và góp phần bảo đảm chủ quyền toàn vẹn lãnh thổ quốc gia; giữ vững bản chất Nhà nước của dân, do dân và vì dân nhằm mục tiêu dân giàu, nước mạnh, xã hội công bằng dân chủ văn minh và nâng cao trình độ dân trí và nguồn lực phát triển kinh tế - xã hội vùng dân tộc thiểu số và của cả nước

4. Các giải pháp mang tính toàn diện bảo đảm thực hiện pháp luật về quyền kinh tế, xã hội và văn hoá đối với người dân tộc thiểu số: Rà soát và hệ thống hóa thường xuyên các văn bản quy phạm pháp luật về quyền con người trong đó có quyền kinh tế, xã hội và văn hóa; sửa đổi, bổ sung các văn bản quy phạm pháp luật về quyền của người dân tộc thiểu số phù hợp với các chế định quyền con người trong Hiến pháp 2013; tiếp tục hoàn thiện và đổi mới nội dung văn bản quy phạm pháp luật về quyền kinh tế, xã hội và văn hóa đối với người dân tộc thiểu số ở các tỉnh miền núi phía Bắc; tăng cường sự lãnh đạo của Đảng trong thực hiện pháp luật về quyền kinh tế, xã hội và văn hóa đối với người dân tộc thiểu số ở các tỉnh miền núi phía Bắc; tăng cường trách nhiệm của Nhà nước đối với việc tôn trọng, bảo đảm và thực hiện các quyền về kinh tế, xã hội và văn hóa; đẩy mạnh công tác tuyên truyền, phổ biến pháp luật về quyền kinh tế, xã hội và văn hóa nhằm nâng cao nhận thức của đồng bào dân tộc thiểu số.

SUMMARRY OF THE MAJOR CONCLUSIONS

1. The implementation of laws on economic, social and cultural of the ethnic minorities is an overall operation with purposes and intention of government agencies, social organizations and the individuals from ethnic minorities to make legal documents on economic, social and cultural rights come into effect to the people’s life.

2. The requirement to implement the law on economic, social and cultural rights of ethnic minorities must ensure the right beneficiaries, as well as to ensure openness, transparency, equality and must be compatible with international standards and uphold the human rights recognized in the Constitution in 2013.

3. The implementation of laws on economic, social and cultural rights of ethnic minorities is an effective means to help minorities to develop mastery capacity, actively engaged in the state and society management; is a method to ensure the social security, border security and contribute to ensuring the territorial integrity of sovereign nations; hold the nature State “of the people, by the people and for the people” to achieve the goal of a prosperous people and a strong, democratic, equitable and civilized country and to raise literacy levels and social - economic development resources – in the area of ethnic minorities and of the country.

4. The comprehensive solutions to ensure the implementation of the law on economic, social and cultural rights of ethnic minorities are as follows: Review and codify frequently the legal documents on human rights including economic, social and cultural rights; amend and supplement legal documents on the rights of ethnic minorities in accordance with the rules of human rights in the Constitution 2013; continue to improve and innovate the content of legal documents on economic, social and cultural rights of ethnic minorities in northern mountainous provinces; strengthen the Party's leadership in the implementation of laws on economic, social and cultural rights of ethnic minorities in northern mountainous provinces; strengthen the State's responsibility to respect, ensure and implement human rights on economic, social and cultural aspects; promote the dissemination and popularisation of laws on economic, social and cultural rights in order to raise awareness of ethnic minorities.
